Can I be evicted because I filed bankruptcy?
No, you cannot be evicted from your rental simply for filing bankruptcy. However, keep in mind 2 very important things:
- You still need to pay your rent. If you fail to pay your rent to your landlord, your landlord can begin eviction proceedings.
- If your landlord has already received a judgment against you AND has already begun eviction proceedings, filing bankruptcy will not stop the eviction. The Automatic Stay only applies before your landlord begins eviction proceedings.
